I just got a post card in the mail about a Class Action Lawsuit against Bank of America. The lawsuit is in regards to people who had a checking or savings account with them and used a debit card.
Bank of America used really shady practices for people who withdrew from their accounts with debit cards. What they did is instead of posting transactions in correct time frame by date, they posted transactions in order from highest withdrawal to lowest withdraw.
Because of this, if your account was say, $1000. And then you withdrew $200, then $300, then $500 and then $1000 - you would get 3 overdraft fees instead of 1.
Now as a poker player this actually screwed me over multiple times, especially in conjunction with this thing bank of america did where for some reason they would say that my check had cleared and update my account balance online but not actually put the money in my account. Then I would withdraw money that made me overdraft because the money from my check always took 10 million years to get the money into my account.
These 2 things in conjunction actually ended up costing me hundreds and hundreds of dollars, because for a while I had to pay bills and I would be cutting it really close on how much money I had in my account, and then Bank of America would fuck me over and overdraft fees would add up like mad and I'd have no way to pay back my negative account. Sometimes I'd know I was probably going to get 1 overdraft fee and prepare for it but then because of what this class action lawsuit is about I would get 3 or even 4 overdraft fees and it put me in deep shit financially.
So, long story short, fuck bank of america, I am definitely joining this Class Action. It sounds like I might get $50-$100 out of it or something.

They already did, they agreed to settle for 410 million.

| Holy shit, talk about shady business. Personally I use Wells Fargo, but I used to use BofA. I hope people find more flaws in society like this one. I hate to say it but its things like that that keep the rich getting richer and the poor getting poorer. |

| Got a check for this today amounting to $35 for every overdraft charge since 2001. Dunno what the exact amount is as my wife has the check, but I'm guessing at least $500. |

I changed from Bank of America like two years ago and haven't regretted it. They pissed me off a lot, approving automatic transactions instead of declining due to insufficient funds. They are really great at getting overdraft fees from you. Never had this problem at my new bank.
I actually had to go to BoA today about an old savings account and wouldn't you know it, "Sorry sir our computers are down." |

Many banks do this or used to do this.
Their rational is say your mortgage is due just before it is paid, you buy a soda and dinner, then pay your mortgage. If the soda and dinner get paid before the mortgage and droped your balance below what the mortgage payment, the missed payment would mess up your credit, thus they just assumed you would rather pay them $50.00 in overdraft / bounced check fees then miss a mortgage payment. Of course if your mortgage is with the same bank it seems even shadier.

Yeah sorry, apparently I heard wrong. We didn't get a check, but we got a mail stating they would be paying $35 for every overdraft since 2001, legit or not, unless we declined to receive payment within thirty days. |

| ive recieved the same thing and was in the same boat. i had a bunch of small purchases like 10 and they sent a high amount through and charged me 10 overdraft fees it was pretty insane. I tried to talk to them but they made me pay it. Ill be interested to see, i heard it was like 15 percent of what u were charged and itll be credited to your account. we will see. |
