You can't say something offends you. People teach you to ACT 'OFFENDED', to make these claims that it is 'hurtful'. but offense, as I've already defined using a REAL dictionary that are used by colleges and business all over the English speaking world shows us that you can't be offended by a word. It's an ACT. A breaching of the law.

The only thing I've found that comes close to what you quoted was a 'Clear and present danger' clause made by the Supreme Court (which means you can't yell fire in a building as people may begin to stampede).

Saying Nigger/Nigga/Faggot/Fag/ etc are not a clear and present danger.

Edit: Also Slander/Libel are a few exemptions, but since none of the above has anything to do with what we are talking about, There is no correlating relevance.

For crying out loud, this feels like a corporate overreaction by EG.

Orb, you are great and will continue to be so. Like almost all people on this world I have called, and have been called, all kinds of hurtful things, deserved or not. I guess in America N--- is more of a big deal than in Europe, but I still do think this has been blown way out of proportion

You don't get it. The First Amendment protects you from the government interfering with your speech, it doesn't protect you from private citizens oder corporations from interfering with it. For example TL can ban you for saying something the mods didn't like. And a company may fire an employee for saying things they don't like.
Maybe another example might help you: The First Amendment prohibits public schools from teaching about God. But a catholic private school can teach whatever they want about God.

This has nothing to do with the First Amendment. It might be a case of wrongul termination, but for that you would need to know the contents of the contract between orb and EG.

I am guessing there was a clause in his contract that stated he could be let go for any reason. I have had this stipulation in a job offer. Also some jobs here in the US start out with a probationary period were u can be terminated for a number of reasons that a non-probationary worker would never get terminated for.

wow this thread is long :D

IMO I wouldn't have said what orb said but it shouldn't be a big deal that he flamed someone, and maybe it offended some people but if he has the "mature language" button on his stream then no one can really be too upset.

The problem was that he lied about it and then EG backed him up and told everyone he didn't do it and that was a big mistake. He should have owned up to it and he ended up making EG looking bad and that's why they released him from his contract and that is perfectly understandable.

Even though you represented your professional self in a poor way via slander and hurtful comments, it takes a serious, meditated, and mature person to come out publicly and recognize, clarify, and apologize to a large audience. This is most definitely an important step in your career if you mean what you say in the original post.

That would make it contractual, not necessarily legal. If and when the contract is ruled illegal, you're left with nothing.

As i said above in this thread, and in MY opinion, under French law, EG's decision wouldn't stand a chance in court. I wish the SC2 community was sufficiently educated in law matters to be as shocked as I am at the moment.

We don't want light minded, insulting casters - fine. We shouldn't be lenient about cow-boys employers either.

Professionalism, sure, but professionalism for all, then.

Not any reason, it has to be related to the employee attitude (can't be related to the company only, for instance).

Also what it does, in France at least, is remove the constraint of a long procedure. The procedure is much quicker. The decision still has to be motivated by serious (and related to the employee) reasons, though.


Edit : the duration of probationary period is also not fixed but depends on the overall lenght of the main contract it's attached to.
