The Kuberts' lawyer, Stephen Weinstein, told the Daily Record that Colonna, 19 at the time of the crash, should be held liable because she was "electronically present" by way of her texts.
So, some idiot texting while driving crashed into a motorcycle. There was two peole on the cycle, and they both lost a leg. They want to sue the girlfriend of the idiot. She wasn't inside the truck of the idiot driving, she was completely elsewhere. They want to say she is responsible for his negligence. Complete fucking bullshit.
If the woman who "created negligence" is sued, then this opens up a world of fuck for so many people. If she does get sued, I'll probably never text anyone ever again. I get that checking your phone while your driving is completely retarded beyond all measure, but to say the person who texted the driver is just as responsible? She didn't force her boyfriend to check the phone when he was driving, did she?
There are other ways to go about making the issue of texting while driving, or doing anything else really. Instead of punishing the texters, you punish anyone and everyone who even touched their phone while driving. These people, while in the right to sue the driver who was texting, should either start their own campaign agaisnt T.W.D. or join someone else's campaign.

How exactly does a pickup driver hit someone head-on anyways? Would love to know how the accident actually happened, motorcyclists are almost always douchebags on the road.
Not saying the guy isnt to blame though

When I hear about situations like this I just imagine myself being the judge in court. I would only say one thing: "What if everyone sued others for things like this?" Then I would walk out.

I'm going to go ahead and disagree with everyone here and say that this depends on the specifics.
If they'd been texting back and forth while she knew he was driving then I'm absolutely fine with her being considered liable to some degree. Not 100%, but some responsibility must surely rest on her shoulders. Last edit: 2012-05-24 15:56:05 |

| I saw this story on the news, the kid was texting his girlfriend while driving...she knew he was driving as well. I am all for it. I generally don't even answer my phone when I am driving. |
